12. Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. 

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible 

In order to contract with Caballero Wear you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Caballero Wear retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be CABALLERO When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. 

13. Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card or have sent you the invoice. 

14. Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'. Depending on the country of origin VAT, fees and taxes might be charged extra. 

The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies. 

a. Payment

Upon receiving your order we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorization check has been completed. Your card will be debited once the order has been accepted. 

b. Discount Codes

Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made through this Website. The conditions of use relating to any discount code will be specified at the time of issue. These T&Cs relate to all Caballero Wear promotions, competitions and discount codes (unless otherwise stated). • Only one promotion code can be used per order. • A promotion code can't be used after an order has been placed.

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

These terms and conditions are to be construed in accordance with the laws of Sweden and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Swedish courts. 

24. Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Caballero Wear. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Caballero Wear.

Inside EU

Normal delivery time is 3-5 working days, express delivery time is 2-3 days. When your order leaves our warehouse we will send you an email together with the tracking number.

Outside USA

Normal delivery time is 4-6 working days. When your order leaves our warehouse we will send you an email together with the tracking number.

Standard shipping: Free shipping - Excluding Taxes and Duties

Our carriers deliver during normal business working hours and may require a signature on receipt, so we suggest your order is delivered to an address where someone will be available to accept it.

Taxes and Duties

Any charges on a package must be paid by the person receiving the package. Caballero Wear has no control over these charges and we can't tell you what the cost would be, as customs policies and import duties vary greatly from country to country. In order to be sure of the current changes, please take contact with your local customs office.

How long does delivery take?
Orders normally take 2-6 working days to arrive. Orders are delivered during office hours (8am-5pm) Monday to Friday, not on public holidays.

What does shipping cost?
Standard domestic shipping USA is free. Shipping outside USA costs $80 USD

Can I change/cancel an order?
Your order normally dispatches the same day or latest by the next working day. If we haven't  yet dispatched your order, you are welcome to contact us and cancel your order.

Which payment options do you provide?
We accept Visa, Mastercard, Diners, American Express and Paypal for all our markets.

Why have I not received an order confirmation?
Always be sure that your email address is correct as an incorrect email address is the most common reason for not receiving an order confirmation. It may also be that your email provider has a SPAM filter that blocks certain emails. If you are still unable to find it, please contact customer service to check that your order has gone through.

Can I return an item?
Yes, as a customer you always have 365 days to return. We do follow the distance selling regulations. 
You should enclose the original packaging and the shoes cannot be used when returned. Fill in the return slip provided with your goods and send your parcel to the address below. You are responsible for the cost of returning the items. However for defective or incorrect products, please contact customer service who will arrange a free return for you.

Where is my order?
If you have received both an order confirmation email and a delivery email, please check your tracking number on www.fedex.com. If you have not received both the emails mentioned above or cannot find your tracking number on the Fedex website, please contact  customer service.

Do you restock items once they have been sold out?
It depends on the particular item. If it is a product that comes from our regular range it is most likely that it will be re-stocked. If there is a specific product that you are seeking, then you are always welcome to get in touch with our customer service team and we will check this for you.

What countries do you ship to?
We deliver to most of the countries. If you cannot find your home country in the drop down at the checkout, please contact customer service and we will try to find a solution for you.

I need to change something on my order. How can I do that?
If you need to change or cancel your order, please contact us immediately. We generally process orders within the same day or the next working day, and once our warehouse has processed your order, we will be unable to make any changes.   

I just placed my order.  Can I add another item to it?
Unfortunately we cannot add items to an existing order. Please place a new order for the item and contact us. We’ll be happy to waive shipping on this additional order if we have not dispatched your first order. 

How long does it take to process my return?
Once we have received your package, your refund will be processed within 14 working days. You will be notified via email at the address listed on your account when this transaction has taken place.

Please note that your banking institution may require additional days to process and post this transaction to your account once they have received the information from us.

Pre-order

If you place a pre-order, money will be deducted from your balance once you place the order in our checkout. The shoes that you have ordered will be sent out to you the same day as they are delivered to our warehouse. If you place a pre-order you are always welcome to contact us before we dispatch your shoes in order to make a cancellation.

RETURNS POLICY

Exchanges

You can return an item for an exchange if you would like a different colour or size of the same item. If you want a different item, then you'll need to return the unwanted item for a refund and place a new order. All exchanges must be placed within 30 days from the day you have received the order from us.

When you exchange your order, please include the return label with the following details marked on it:

• Your order number

• Which items you’d like exchanged or refunded

• The new size or color you’d like of the items to be exchanged

If you haven’t indicated on your returns note that you’d like an item exchanged or the new size or colour required, then we’ll automatically issue a refund for the returned item. We'll send you an email to let you know once we've received your return with the details of any refunds and exchanged items. If an item is out of stock we’ll let you know we couldn’t exchange it and issue a refund instead. If an exchange is available, we’ll send you another email once your new item has left our warehouse.

Any exchanged items will be sent to the default delivery address on your account using the same delivery service as your original order. If we’ve refunded you for any items, the funds can take up to 10 working days to appear in your account depending on your bank/card issuer.

Note that the customer is responsible for the return costs when exchanging color or size. You can send the package through a postal service of your choice. When we have received and registered your returned item/s in their original condition, we will start processing your exchange request. We will pay for the shipment of the new product that is sent to the customer. 

Return Policy

• Products can be returned within 365 days after the order has been received from us. 

• Products must be in original condition and cannot be used. Please try shoes on a clean, carpeted area.

• All returns must include the original shoebox in its original condition.

Refunds and Processing

When you return your order, please include the return label with the following details marked on it:

• Your order number

• Which items you’re returning for a refund

• The reason for returning

Unless we delivered the item in error or the item is faulty or damaged, the customer is responsible for the return costs. You can then send the package through a postal service of your choice. When we have received and registered your returned item/s in their original condition, we will start processing your refund.

The returned product/products remains your responsibility until it arrives with us. Remember to ask for proof of postage, so if your return goes missing in the mail, you’ll have proof you’ve sent it. We’ll send you an email as soon as we’ve received your return back at our warehouse in its original condition. Once received, we'll apply your refund to your original payment method and this is usually done within 1 working day. We try hard to accept all returns, and returns to us don’t need to be in the original packaging. In the unlikely event that an item is returned to us in an unsuitable condition, we may have to send it back to you. Refunds will appear in your account within 5 working days depending on your bank/card issuer. Unfortunately, we cannot refund duties, taxes or shipping charges.

Complaint

We try to ensure that your goods arrive free from defects. However, should you receive faulty items or an incorrect delivery, please make sure you contact our customer service team as soon as possible and no later than 14 days after delivery. We will arrange for a free courier return service in such cases. When a complaint is made an investigation of the product is carried out, in some cases we will send your complaint for further investigation to the supplier. Your views are highly valued, therefore we ask you to contact us to give us your opinions and express your concerns.
